What is the Family Medical Leave Act (FMLA)?
FMLA is an act that applies to companies of 50 or more employees and to employees who have worked for the company over a year or 1250 hours. It allows each employee a total of 12 weeks of unpaid leave because of a serious health condition during any 12 month period. During this period of time, the employee is allowed to elect or the employer may require the employee to substitute accrued paid vacation, sick or personal time.
Furthermore, if an injured worker takes FMLA and cannot return to work after 12 weeks, the employer is not obligated to hold the job open indefinitely and rehire the worker at a later date.
